Terms of Service

By accessing or using Tonpit (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.

You must be at least 13 years old to use this Service. By using Tonpit, you represent that you meet this age requirement.

Tonpit is an AI-powered video creation platform. The Service includes:

• AI-generated typography, designs, and motion titles
• AI video generation from prompts and media you provide
• The Studio editor for composing and editing videos
• AI voiceover generation
• The Tonpit UI Capture browser extension for capturing website layouts
• Templates and export to various formats (PNG, SVG, MP4, ProRes)

Features and functionality may change as we develop the product.

New users receive a free allocation of AI generations, Studio actions, and exports, as displayed in the app. A paid subscription is required to continue using Tonpit beyond the free allocation.

Please note:

• Features may be added, modified, or removed as we develop the product
• The Service may experience downtime or interruptions
• We may adjust usage limits at our discretion
• Beta features: Features marked as beta, experimental, or early access are provided for evaluation. They may be unstable, may change significantly, and may be removed without notice. They carry no availability or quality commitments

To use Tonpit, you must create an account using Google authentication or email/password. You agree to:

• Provide accurate account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

After the free tier, Tonpit requires a paid subscription.

Billing

• Subscription plans: Monthly or annual billing cycles, as displayed at the time of purchase
• Auto-renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Payment processing: All payments are processed securely by Lemon Squeezy, our Merchant of Record. We do not store your credit card information
• Price changes: We will provide at least 30 days notice before any price increases. Existing subscriptions are honored until the end of their current billing period

Usage Limits

Each plan includes monthly limits on AI generations, Studio actions, exports, and other features, as displayed on the pricing page at the time of purchase. Unused monthly allocations do not carry over to the next billing period.

Media Credits

Some features (such as AI video and voiceover) consume media credits. Credits come in two forms:

• Purchased credits: One-time top-ups. They do not expire while your account is active, have no cash value, and are non-transferable
• Included monthly credits: Granted by certain plans. They reset each billing cycle and do not carry over

Credits that have been spent on generations are not refundable, including when you are unsatisfied with an AI output, since the underlying processing cost has already been incurred. All remaining credits are forfeited when your account is deleted or terminated for violating these Terms.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you retain full access to Tonpit until the end of your current billing period. After that, your account reverts to a free state and your projects remain accessible but you will not be able to generate new designs.

Refunds

• Subscriptions: We offer a 14-day refund window from the date of your first payment. If you are not satisfied, contact us within 14 days for a full refund. After the 14-day window, refunds are not available for partial billing periods
• Credit top-ups: Unused purchased credits are refundable within 14 days of the purchase. Credits that have been spent are not refundable

Refunds are processed by Lemon Squeezy and typically take 5-10 business days. Nothing in this section limits any non-waivable refund rights you have under the consumer protection laws of your country of residence.

You agree not to:

• Use the Service for any illegal purpose
• Generate content that is defamatory, obscene, or infringes on others' rights
• Generate voiceovers or videos that impersonate a real person in a misleading or deceptive way
• Use UI Capture to collect personal information about others, or to capture content from sites that prohibit it
• Attempt to circumvent any usage limits or access controls
• Use automated tools to access the Service without permission
• Reverse engineer, decompile, or attempt to extract the source code
• Resell or redistribute the Service without authorization
• Interfere with or disrupt the Service's infrastructure

Your inputs: You retain ownership of the prompts, text, media, and other content you provide to Tonpit.

License grant: By using the Service, you grant us a limited license to host, process, and transmit your content (including to the AI providers and infrastructure services described in our Privacy Policy) solely to provide the Service to you.

Storage: Uploaded media and rendered videos are served through direct links and can be viewed by anyone who has the exact link. Do not upload content you need to keep strictly confidential.

Your responsibility: You are solely responsible for ensuring that content you upload or capture does not violate any laws or third-party rights.

UI captures:When you capture a website, the captured layout, text, images, and fonts may be protected by the rights of that site's owner. You are responsible for ensuring you have the right to capture and use that material, and for complying with the source site's terms. We provide the capture tool as-is and are not responsible for how you use captured material.

Tonpit uses third-party AI services (including Anthropic, Google, fal.ai, and ElevenLabs) to generate designs, videos, and audio. Regarding AI outputs:

• Ownership: As between you and us, you own the outputs generated from your inputs, subject to the limitations below. We do not claim ownership of them
• No guarantees: AI outputs are provided “as-is.” We do not guarantee they are unique, accurate, original, or suitable for any particular purpose. Similar or identical outputs may be generated for other users
• No infringement warranty: AI outputs may unintentionally resemble existing works. We make no warranty that outputs do not infringe third-party rights, and you use them at your own risk
• Your responsibility: You must review all outputs before use, and you are responsible for how you use them, including compliance with applicable laws and any disclosure requirements for AI-generated content in your jurisdiction
• Commercial use: You may use outputs for commercial purposes, subject to the above

We respect intellectual property rights. If you believe content created or hosted through Tonpit infringes your copyright, email hello@tonpit.com with: (a) identification of the copyrighted work, (b) the location of the allegedly infringing material, (c) your contact information, (d) a statement that you believe in good faith the use is unauthorized, and (e) a statement, under penalty of perjury, that you are the rights owner or authorized to act for them.

We may remove or disable access to allegedly infringing material and may terminate the accounts of repeat infringers.

Our property: Tonpit, including its design, code, AI prompts, and branding, is owned by Itay Rose Ari. You receive a limited, non-exclusive license to use the Service for its intended purpose.

Feedback: If you provide suggestions or feedback about Tonpit, we may use it without compensation or attribution to you.

Tonpit integrates with third-party services including:

• Lemon Squeezy — Payment processing (Merchant of Record)
• Anthropic (Claude API) — AI processing
• Google (Gemini API) — AI processing
• fal.ai — AI video generation
• ElevenLabs — Voiceover generation
• Google Firebase — Authentication and data storage
• AWS (Remotion Lambda) — Video rendering
• Vercel — Hosting
• Mapbox — Maps in map-based templates

Your use of these services is subject to their respective terms. We are not responsible for third-party service availability or issues.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted or error-free
• AI-generated outputs will be accurate, unique, or suitable for your needs
• The Service will meet your specific requirements
• Any errors will be corrected

To the maximum extent permitted by law, Itay Rose Ari shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law, and nothing in these Terms limits rights that cannot be waived under the laws of your country of residence.

You agree to indemnify and hold harmless Itay Rose Ari from any claims, damages, or expenses arising from:

• Your use of the Service
• Content you create, upload, capture, or input
• Your violation of these Terms
• Your violation of any third-party rights

By us: We may suspend or terminate your access at any time for violation of these Terms.

By you: You may stop using the Service and delete your account at any time.

Effect: Upon termination, your right to use the Service ends immediately. Sections on intellectual property, disclaimers, liability, and indemnification survive termination.

These Terms are governed by the laws of Israel. Any disputes shall be resolved in the courts of Tel Aviv, Israel. If you are a consumer, this does not deprive you of the protection of mandatory consumer laws of your country of residence.

For disputes under $10,000, we agree to first attempt resolution through informal negotiation for at least 30 days before initiating any legal proceedings.

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
